— On Thursday, Gov Abbott said in a news release: “Throwing Texans in jail who have had their businesses shut down through no fault of their own is nonsensical, and I will not allow it to happen.”

“That is why I am modifying my executive orders to ensure confinement is not a punishment for violating an order. This order is retroactive to April 2nd, supersedes local orders and if correctly applied should free Shelley Luther.” —

In a letter to state District Judge Eric Moyé, Texas Attorney General Ken Paxton called Shelley Luther’s sentencing outrageous.

“The trial judge did not need to lock up Shelley Luther,” Paxton wrote. “His order is a shameful abuse of judicial discretion, which seems like another political stunt in Dallas. He should release Ms. Luther immediately.”

“As a current Member of the Bar, you certainly should be aware of the impropriety of this contact, as prohibited by Canon 3(b)(8) of the Texas Code of Judicial Conduct,” the letter to Paxton stated. “In this context, for you to “Urge” a Judge towards a particular substantive outcome in this matter is most inappropriate and equally unwelcome. Please do not communicate with the Court in this manner further.”

The letter was obtained by the Dallas Morning News. It was signed by Eric Moyé, the judge who sentenced Luther, and 11 others.

The cover of a national medical emergency — and so the emergence of COVID-19 was that for a brief period — made way for the absolute power of governors (whose states have rightly had jurisdiction over emergencies within their boundaries) who then got their constituents to shutter their businesses and leave their jobs, willingly or not, in the name of containing the (uncontainable) contagion. Now has come the time to reverse tracks, assess and address the damage done, and get America fully back to work — and then some.

I don’t know how bad the Draconian fascist / socialist COVID-19 edicts may really be given two broad variables: the ratio of confirmed infections to morbidity. In the rural county in which I live, we have had 173 confirmed “cases” and three related deaths, or 173:3 or 0.0173 (so far).

Also, I keep in mind both my unreported experience and the plain fact that on the side (made it!), I have never breathed more clearly or deeply in my life.

Who am I threatening with C19 and who is threatening me that I must wear a mask?

The classical liberalism of conservative Americans suggests the nation has not only bungled the handling of an alien virus but too willingly given over and been driven from businesses and jobs to assuage fears built up by those who today knowingly convey big infection numbers while minimizing information related to death: how old was each “victim” and with what prior conditions in play, including related exhaustion and stress on the way to catching C19?

How many nursing home grandmas have to die before family and others realize that getting up there in age becomes just plain risky no matter what? Add the complication of preexisting conditions. BackChannels has now often reminded its readers that of 328 million Americans, it is perfectly normal for 2.813 of the same to die (from all causes) in the course of a year.

Add age, infirmity, or otherwise deeply compromised health, and, yes, C19 has just made those operating conditions a little more interesting.

Declaring a National Emergency in haste and watching that power transfer to governors intent on saving face while accomplishing political agendas appears to have handed over to the same unchecked power. I’m calling this massive phenomenon stoked by fear and made broadly controlling “Yo-Yo Fascism and Yo-Yo Socialism”. Governor: “May we . . . ” drink in a bar, go to church, worship together in warm company (“Zoom” ain’t hackin’ it), or go out and get lost in the garden center of the hardware store without wearing the Hijab of Science Nazis?

This is not about reasonable and reasoning conservatives or liberals although some zealots would like everything evil to be identified with their blue or red flag enemies: the willingness to wear the mask may have to do with the near impossibility (for the moment) of organizing a smart opposition to such display both of power and ready acquiescence to it.


Yo-Yo Fascism & Yo-Yo Socialism

American political power has acquired the rope needed for strangling freedom.

It’s attached to COVID-19 and the impression believed about it. When it appears to be receding, the rope may be let out a little bit; when it appears to be resurgent, it may be tightened.

In natural and normal American custom, we are each responsible in reasonable measure for our own practical personal defense, financial, health, and security needs. We do the things we need to do, and we don’t expect our healthy neighbors to alter their behavior to accommodate what in general have been regarded as special needs.

If you need to live in an hermetically sealed bubble, do it, but don’t ask or expect your fellow American to play along with you or nod in social agreement while steaming silently over what today’s policies have done to his business, employment, and family.

Once an public emergency has fully emerged, it ends.

The rest is public policy and either in keeping with the nation’s Constitution or not.

The report, written by the Chemical and Biological Intelligence Unit of the FBI’s Weapons of Mass Destruction Directorate (WMDD), does not give the name of the Chinese scientist carrying the suspected SARS and MERS samples, or the intended recipient in the U.S. But the FBI concluded that the incident, and two other cases cited in the report, were part of an alarming pattern.

Whether in recent years or over many, there appears no end in relation to the breadth and depth of Chinese espionage in the United States. The cost to Americans: well into the billions of dollars.

Of immediate concern: could C19 (COVID-19) have escaped or even been ferried from the kind of lab that works with deadly pathogens?

According to a recent American Military News article (“Report: FBI warned of Chinese researchers transporting disease samples in US before coronavirus”, March 31, 2020 by Ryan Morgan), the FBI in 2018 had a least twice detained Chinese researchers transporting dangerous biological materials, and in 2019 U.S. Customs and Border Patrol agents had stopped a Chinese researcher ferrying E.coli out of Detroit.

As Dr. Antilla proceeded with his academic career, United States officials changed their view of China’s recruitment programs, which they say have been used to steal sensitive technology from American laboratories.

In 2019, the Department of Energy barred its personnel from participating in recruitment programs from a handful of countries, including China. A few months later, a Senate committee declared China’s recruitment programs a threat to American interests.

Much of the reference section has been lifted from a previous post — “Note: COVID-19, Biological Warfare, and the Odds and Ambiguities” (March 19, 2020), but a few cogent others have been added to this growing collection of tributes to the theft of industrial, scientific, and state secrets by the People’s Republic of China on the world’s Internet-connected international stage.

Of course, where would any state’s security — or international agenda — be without its spies?

The trade is a fact of life also worldwide.

Nonetheless, this from Reuters provides a glimpse at the lucrative and powerful payoffs so far enjoyed by China given perhaps allowances for its investments (and recruitment) through the Thousand Light programs as well as an apparent absence of sufficient resistance to being intellectually tapped for the nation’s most sensitive scientific secrets.

China’s efforts to steal unclassified American technology, ranging from military secrets to medical research, have long been thought to be extensive and aggressive, but U.S. officials only launched a broad effort to stop alleged Chinese espionage in the United States in 2018.

“The theft of American trade secrets by China costs our nation anywhere from $300 to $600 billion in a year,” Evanina, director of the National Counterintelligence and Security Center, said in advance of Thursday’s conference.

How much money have Federate and State governments poured into emergency preparedness in the region of Chemical Biological Radiation and Nuclear (CBRN) preparedness?

California had made itself ready for a C19 type event for years — and then it decided the price associated with foresight was too high.

The simplest way to judge whether we have an exceptionally lethal disease is to look at the death rates. Are more people dying than we would expect to die anyway in a given week or month? Statistically, we would expect about 51,000 to die in Britain this month. At the time of writing, 422 deaths are linked to Covid-19 — so 0.8 per cent of that expected total. On a global basis, we’d expect 14 million to die over the first three months of the year. The world’s 18,944 coronavirus deaths represent 0.14 per cent of that total. These figures might shoot up but they are, right now, lower than other infectious diseases that we live with (such as flu). Not figures that would, in and of themselves, cause drastic global reactions.

What are China’s authorities hiding or trying to hide?

It’s remarkable watching the hiding of shame (or guilt) play out on the global stage.

There are people who believe — and when they’re leaders, they may be the worst of people — that any show of damage, fear, or sentiment weakens them in relation to public perception when, in fact, it is their own “inner eye” (the way the may be forced to view themselves) that cannot stand being seen as weak. In that may be the soul of “malignant narcissism” and related “civilizational narcissism”.

Such types embarrass and shame themselves, for what seems right to them looks wrong to everyone else.


Dogma may no longer serve to cover or excuse less savory designs.

Our species evolves not only physically but psychologically, and we have reached an age with sufficient global and open communications in which authoritarians, criminals, and dictators may no longer brush aside or suppress essentially truthful criticism and data. The same may not stop “black programs” and conversations “behind the curtains” — that kind of feudal and medieval egotism and power may be always with us — but by and large BackChannels believes the world evolves toward greater complexity, interdependence, and freedom. The global public may still be misled, but not for long provided the journalists have integrity and do their work.

Between the people of the United States and the nation’s most prominent authority on infectious disease and pandemic, the Centers of Disease Control, hide nothing, sugarcoat nothing but report accurately, plainly, clearly, empirically, completely–and that may be the best cure this editor might know for panic and state-driven perceptual control of “the masses”.

In America, at least, democracy has just become more directly responsive and responsible to the People.

That, of course, seems a little spooky.

BackChannels has expressed concern (an understatement) in relation to Maryland’s “standing down” its bar and restaurant businesses plus entertainment / events that involve complex business communities on which thousands people depend, and, in many ways, the state’s economy and well-being depend as related revenues vanish right along with associated tax revenues and — should we go more than six weeks (just a guess) with the doctor’s program — jobs and tax base.

Will the now dragging Trump Administration allow the emergency to extend into November with inevitable political unrest and violence as his economy melts down over the bug?

Might the President and states now participating in similar suppression of the transmission of COVID-19 take the opportunity to apply additional “Draconian Measures” for the same reasons?

Could this be America’s Reichstad Fire?

BackChannels notes that the worst of COVID-19 cases require biologically secure environments and ventilators (until better answers come along). The nation has the capacity to produce both post-haste —

Okay.

Institutionalize emergency measures into an ongoing American reality that will become a quagmire of suffering and violence (outcomes possibly worse than the illness itself)?

No.

Localities and states may need to embrace the idea of ponying up for temporary facilities and ventilators PDQ to keep their economies afloat and even vigorous while Washington, the President, and the Federal Government on the Emergency Management and Politicking side of things dick around with other “bugs” up their butts.


Disclosure: the editor of this blog has cause to believe he experienced his worst of the latest between February 15 and February 25 with spiking into a full Bronchial Symphony of Wheezing (you have no idea how many the sounds!) and days and nights without sleep between the 21st and 24th (right on time). Impression: whatever it was dominated the immune system. Three weeks out: all passageways (and voice) stunningly clear and normal! Thank God.

Drone Bomb Swarms?

From The Jerusalem Post piece:

The greatest threat confronting the US and Israel may be swarms of drones armed with chemical weapons released by Iran or ISIS, an ex-CIA official has told The Jerusalem Post.The warning takes on greater meaning following a call on January 28 by ISIS’s new leader, Abu Ibrahim al-Hashimi al-Quraishi, to direct greater attention to attacking Israel and Jews, including using chemical weapons.

In relation to the latter piece, attack have been already thwarted but with the details withheld by the CIA.

America’s “Far White Right” Republicans, who haven’t had much to do with reality either these days, have scraped up the mud mixture to attempt to splatter the Democrats thoroughly in the old Soviet zeitgeist and call their opposition “Un-American!”


Times of Israel blogger Fred Maroun asked on his Facebook page, “Is Netanyahu racist, as Sanders claims?”

After taking care of the Netanyahu question — not racist! — Maroun went on to defame Sanders. Here’s what he said:

Sanders, on the other hand, is an antisemite. He’s using the antisemitism of many on the left to gain support, and he has no problem associating with virulent antisemites like Linda Sarsour. He’s never apologized for any of it, on the contrary, he only gets worse. His accusation against Netanyahu is part of his game to attract those people. If he wants to criticize Netanyahu on the settlements, fine, but he knows that wouldn’t distinguish him from other Democrats, so he accuses the leader of the Jewish state of being a racist, code word for Jews being racist. His antisemitic base loves it. He uses exactly the same tactics to attract antisemites that Trump uses to attract right-wing racists.

Those who support Sanders are engaging in the the exact same moral acrobatics as those who support Trump. Shame on them.

Bernie Sanders may or may not be far from the habits known to the most religious of synagogue goers — the form of his personal ablutions are an I-Don’t-Know for me (and I don’t want to know!) — but one may recognize in Sanders the crossing point where Judaism became a Jewish Humanism so oriented toward people — and not so obsessed with God — that the rabbi who chose his conclusions over his upbringing (Felix Adler) would go on to establish a new American religious society represented by the term “Ethical Movement”.

Sanders has the frameworks of the New Old Now Old Far Out and Lost Left — a term I used to use as I arrived here a conservative, and, sigh, the Left of my youth seemed to have drifted toward Noam Chomsky and Chris Hedges on the barricades. That could have been just the way I arrived and “channeled” into Facebook.

Judaism’s Orthodox–>Conservative–>Reform Spectrum has had a last note pinned to it in the figure of Felix Adler.

One might imagine, easily, that those promoting and living a strongly behavioral view of Judaism and Jewish Law bound into Jewish Obedience to the Commandments and related codes (“613 Commandments”) were not too happy with Professor Adler.

Sanders may have that ethical-humanist strain of ultimately Jewish thought in him, but he must also know as a Jew that he is not part of Russo-Soviet complex on the left that spread the “Protocols” throughout Russia and conveyed the same through White Russian emigre into Germany. America’s “Far White Right” Republicans, who haven’t had much to do with reality either these days, have scraped up the mud mixture to attempt to splatter the Democrats thoroughly in the old Soviet zeitgeist and call their opposition “Un-American!”

Bernie’s a liberal Jew. (I’ve been part of Reform Judaism — and Ethical Society much, much earlier — but am tired now “of all that” and prefer a quiet supper in a good restaurant on the Sabbath). Regarding Sanders’ political and social views, I would bet his position similar to Adler’s and what I without study would refer to as “Jewish Humanism”.

What I Have Said About the Jews

My people, not that I speak for them, I nonetheless describe as a "global ethnic commune with its heart in Jerusalem and soul in the Land of Israel."

I may suggest that anti-Zionism / anti-Semitism are signal (a little bit) of fascist urges, and the Left -- I'm an old liberal: I know my heart -- has been vulnerable to manipulation by what appears to me as a "Red Brown Green Alliance" driven by a handful of powerful autocrats intent on sustaining a medieval worldview in service to their own glorification. Too often, the security found in the parroting of a loyal lie outweighs the integrity to be earned in confronting and voicing an uncomfortable truth.

Those who make their followers believe absurdities may also make them commit atrocities.

On Press Freedom, Commentary, and Journalism

In the free world, talent -- editors, graphic artists, researchers, writers -- gravitate toward the organizations that suit their interests and values. The result: high integrity and highly reliable reportage and both responsible and thoughtful reasoning.

This is not to suggest that partisan presses don't exist or that propaganda doesn't exist in the west, but any reader possessed of critical thinking ability and genuine independence -- not bought, not programmed -- is certainly free to evaluate the works of earnest reporters and scholars.
